Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of the ApexTruss healthcare platform and services operated by ApexTruss Pte. Ltd. (UEN: 202616461M) (“ApexTruss”, “we”, “us”, or “our”). By accessing or using our services, you agree to be bound by these Terms.

2. Services

ApexTruss provides healthcare clinic management technology, including patient engagement, appointment scheduling, queue management, and communication tools. Our services are provided to healthcare clinics (“Clinic Partners”) and their patients (“Patients”).

3. For Patients

If you are a patient using our platform through your clinic:

  • Our platform facilitates communication between you and your clinic. We are a technology provider, not a healthcare provider.
  • Clinical decisions, diagnoses, and treatment plans are made by your doctor, not by our platform.
  • Your personal data and health information are processed on behalf of your clinic in accordance with our Privacy Policy.
  • You may opt out of non-essential communications (such as follow-up reminders) by contacting your clinic.

4. For Clinic Partners

If you are a clinic using our platform:

  • You are the data controller for patient data processed through our platform. You are responsible for obtaining patient consent and complying with the PDPA and HIA.
  • You are responsible for the accuracy of clinical information entered into the system.
  • You must ensure your staff are trained on appropriate use of the platform and data handling.
  • Our AI features operate on a facts-only basis and must not be relied upon for clinical decision-making.

5. Health Information Boundaries

Our platform does not:

  • Provide medical advice, diagnoses, or treatment recommendations.
  • Replace your clinic management system (CMS) or contribute to the National Electronic Health Record (NEHR).
  • Include clinical details in WhatsApp notifications or other unsecured communications.

6. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

7. Data Ownership

Clinics retain ownership of all patient data and clinical records. Patients retain ownership of their personal data. We do not claim ownership of any data processed through our platform.

8. Service Availability

We aim to maintain high availability of our platform but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice.

9. Limitation of Liability

To the maximum extent permitted by law, ApexTruss shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of our services. Our platform is a technology tool — clinical outcomes are the responsibility of the treating healthcare provider.

10. Termination

Either party may terminate the service relationship with 30 days' written notice. Upon termination, clinic data will be exported and provided within 30 days, after which it will be securely deleted.

11. Governing Law

These Terms are governed by the laws of the Republic of Singapore. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
